Terms & Conditions.
Last updated · 19 April 2026These terms govern the relationship between Pixel Heaven (sole trader trading as Pixel Heaven, operated by James, based in Witney, Oxfordshire, United Kingdom) and clients who commission websites, hosting, maintenance or the Ledger business dashboard. Placing an order or approving a mockup means you accept these terms.
1. Services offered
Pixel Heaven offers four custom website build systems, each with a monthly hosting & maintenance fee:
- Get Found — £100 build + £20/month
- Get Customers — £250 build + £40/month
- Own Your Area — £500 build + £60/month (includes Ledger dashboard)
- Market Leader — £1,500 build + £120/month (includes Ledger dashboard)
The full contents of each tier are listed on the services page. Prices are in GBP and exclusive of VAT (Pixel Heaven is not currently VAT-registered).
2. Free mockup
Before any payment is taken, Pixel Heaven will design the homepage of your website in full as a free mockup. You may review the mockup and decide whether to proceed. If you choose not to proceed, you pay nothing and walk away with no obligation.
The mockup itself — including its design, layout, copy and visual elements — remains the intellectual property of Pixel Heaven until the build fee has been paid in full. The mockup is not supplied for you to take to another developer to copy or reproduce; doing so is a breach of these terms.
3. Build process and timeline
Once the mockup is approved and the build fee paid, work begins on the live build. Typical turnaround is about 48 hours from approval for one-page sites, and up to 7 days for larger builds, provided the client has supplied all required content (photos, logos, copy, service descriptions).
Timelines are estimates. Extended back-and-forth, unclear feedback or delayed content supply will extend the timeline accordingly. Pixel Heaven cannot be held to a 48-hour timeline if it is waiting on content from the client.
4. Content supplied by the client
The client is responsible for providing photos, logos, service descriptions, pricing and any written copy for the site. The client warrants that:
- They own, or have permission to use, all photos, logos and copy supplied
- Nothing supplied infringes the copyright, trademark or other rights of any third party
Pixel Heaven cannot be held responsible for any legal claim arising from third-party content supplied by the client, and the client agrees to indemnify Pixel Heaven against any such claim.
5. Monthly fees and price lock
Monthly fees cover hosting, SSL certificate, domain renewal, automatic backups, email forwarding and unlimited content updates (within the scope of the tier). Major structural rebuilds, brand-new pages outside the tier's page count, or full redesigns are outside the scope of routine updates and are quoted separately.
Lifetime price lock: Whatever monthly rate is in effect on the day you sign up is locked for as long as your account remains active and in good standing. This lock applies even when Pixel Heaven raises prices for new customers. Only upgrading to a higher tier, or cancelling and re-signing, will change your locked rate.
6. Payment and payment failure
Build fees are due on approval of the mockup, before work on the live build begins. Monthly fees are billed in advance via recurring card payment through Stripe or by bank transfer.
If a monthly payment fails:
- You will be notified the same day
- You have 14 days to resolve the issue
- After 14 days, hosting, SSL and email forwarding are paused and the site temporarily goes offline until the account is brought up to date
- The domain always stays registered in your name regardless
7. Cancellation
Monthly services are rolling and can be cancelled at any time with 30 days written notice (by email to james@pixelheaven.org). The notice period exists so hosting can be wound down, the domain transferred and source files handed over cleanly.
8. Refunds
Because the free mockup lets you evaluate the full design before committing, build fees are non-refundable once work has begun on the live build.
Monthly fees are non-refundable for the month in progress at the time of cancellation. Future months are simply not billed after cancellation takes effect.
9. Ownership and intellectual property
Once the build fee is paid in full, the client owns:
- The design and content of the delivered website
- Their domain name (registered in the client's name from day one)
- All source files (HTML, CSS, JavaScript, images)
Pixel Heaven retains the right to mention the client by name and link to the finished site in its portfolio and marketing materials, unless the client requests otherwise in writing.
If the client leaves, source files are handed over and the domain transferred within 14 days of final payment clearing.
10. Redesigns and migrations
Pixel Heaven can rebuild existing WordPress, Wix, Squarespace or other sites from scratch at the standard build fee for whichever system is chosen. The client is responsible for cancelling any existing hosting, domain or platform subscriptions separately — Pixel Heaven does not manage or close existing accounts on the client's behalf and cannot be responsible for overlapping charges.
11. The Ledger business dashboard
The Ledger business dashboard is included free with the Own Your Area and Market Leader tiers. Ledger is a private business dashboard for tracking invoices, expenses, cash flow, customers, bank balances and basic payroll. It is provided as-is on the client's own domain, password-protected.
Ledger is not statutory accounting software. It does not file with HMRC, does not produce statutory accounts, and is not a substitute for a qualified accountant. The client is responsible for keeping accurate records and for their own statutory filings. Pixel Heaven makes no warranty as to the fitness of Ledger for any particular accounting, tax or regulatory purpose.
12. Liability
Nothing in these terms excludes or limits liability for death, personal injury caused by negligence, fraudulent misrepresentation, or any other liability which cannot be excluded or limited under English law.
Subject to the above, Pixel Heaven's total liability under these terms is capped at the total amount paid by the client to Pixel Heaven in the 12 months preceding the event giving rise to the claim. Pixel Heaven is not liable for indirect or consequential loss, including loss of profit, loss of business, or loss of data (beyond taking commercially reasonable steps to back up the site).
13. Uptime
Websites built by Pixel Heaven are hosted on third-party infrastructure (currently Hostinger). While every reasonable effort is made to keep sites online, Pixel Heaven does not guarantee 100% uptime and cannot be held liable for outages caused by the hosting provider, DNS issues outside its control, or major internet disruptions.
14. Changes to these terms
These terms may be updated from time to time. The "last updated" date at the top will change, and active clients will be notified by email of any material changes at least 30 days before they take effect.
15. Governing law
These terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the English courts.
